The White House Fuels Reports of Imminent 'National Emergency' Declaration on Climate Change
The Biden administration is pushing to capitalize on another national “emergency” in order to accumulate unprecedented executive powers.
The Biden administration is seeking to declare a 'national emergency' on the 'climate crisis' as soon as Wednesday, which many expect to be accompanied by an unprecedented seizure of executive power.
"U.S. President Joe Biden will issue executive orders on Wednesday aimed at addressing the climate crisis," Reuters reported on Tuesday.
"Don’t be disappointed if you don’t see a climate emergency tomorrow," one source told Reuters.
However, the White House is now walking back the reports that a 'national emergency' declaration will happen on Wednesday.
"But I would not plan an announcement this week on a 'national climate emergency,'" White House Press Secretary Karine Jean-Pierre said. "Again, everything is on the table. It's just not going to be this week on that decision."
The Biden administration is expected to invoke 'emergency' powers with the 'climate crisis' announcement.
The Washington Post earlier reported on the White House's intention to invoke a national emergency over climate change.
"President Biden is considering declaring a national climate emergency as soon as this week as he seeks to salvage his environmental agenda in the wake of stalled talks on Capitol Hill, according to three people familiar with the matter who spoke on the condition of anonymity to discuss the private deliberations," the Post reported.
"The potential move comes days after Sen. Joe Manchin III (D-WV) told Democratic leaders that he does not support his party’s efforts to advance a sprawling economic package this month that includes billions of dollars to address global warming," the report added. "If an emergency is invoked, it could empower the Biden administration in its efforts to reduce carbon emissions and foster cleaner energy."
“The president made clear that if the Senate doesn’t act to tackle the climate crisis and strengthen our domestic clean energy industry, he will,” an unnamed White House official said in a statement late Monday. “We are considering all options and no decision has been made.”
The White House is thus seeking unlawful authority over carbon emissions in the wake of the Supreme Court's blow to the Environmental Protection Agency's regulatory powers in late June.
The Biden administration's radical environmental agenda has also been stalled in the U.S. Senate due to Senator Joe Manchin (D-WV) impeding its progress through the upper chamber, The Senate Democrats need Manchin's vote to pass any measures — even through budget reconciliation.
Democratic senators are now pushing for President Biden to take unilateral action to purportedly fight climate change.
"We have a president who campaigned on climate, who has been chained to the legislative process, thinking about his past as a senator," Sen. Jeff Merkley (D-OR) said. "Now he's unchained, and he has to go."
"President Biden is an optimist and a trusting soul and a very patient man," Sen. Sheldon Whitehouse (D-RI) also said. "That trust has not been rewarded. I believe, I hope, that that patience is exhausted."
The Democrats' calls for unlawful executive action in lieu of the Constitutional process of legislative action comes in the aftermath of the Supreme Court's decision in West Virginia vs. the EPA.
"A decision of such magnitude and consequence rests with Congress itself, or an agency acting pursuant to a clear delegation from that representative body," Chief Justice John Roberts said in the majority opinion.
In February, a federal judge blocked the Biden administration’s attempt to “put greater emphasis on potential damage from greenhouse gas emissions when creating rules for polluting industries,” the AP reported.
“The judge issued an injunction that bars the Biden administration from using the higher cost estimate, which puts a dollar value on damages caused by every additional ton of greenhouse gases emitted into the atmosphere,” the report added.
The Biden administration is therefore pushing to capitalize on another national “emergency” in order to accumulate unprecedented executive powers. The Covid crisis thus appears to have been merely a prelude to the global ‘climate emergency’ that has been planned for decades.
If the Biden administration attempts to seize powers with a 'climate emergency' declaration, it would be defying the U.S. Supreme Court and the separation of powers in the U.S. Constitution, in violation of the Presidential Oath of Office.
